Terms & Condition

“The following terms and conditions apply to all digital services of Cyclux Consult to our Clients." - Last updated: 30th May 2020

Unless otherwise agreed or stipulated, our standard invoicing terms are 50% upfront and non-refundable. A further 50% is invoiced upon design or development approval and work completed. If no requests for amendments are made, or the client fails to provide content and/or instruction within 2weeks, the final 50% is payable or project automatically terminates. Please note that we do everything we can to keep a project on track, content collation is often underestimated. If you are unable to provide all your content by the time we have done your project, it does not mean we have not done our job. Once your site is built and ready to go live, whether it has placeholder images or dummy text we will issue our final invoice. Cyclux do not offer credit terms. Invoices are payable within 14 days of the dated invoice and any late payments will incur a cost of 3% per month. In the event of late or missed payments Cyclux reserves the right to take down any website without notice.

Cyclux Consult will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall website development is completed. At the completion of the project, such materials will be deemed to be accepted and approved unless the Client notifies Cyclux otherwise within 5days of the date the materials are made available to the Client.

Client agrees to reimburse Cyclux Consult for any additional expenses necessary for the completion of the work. Examples would be purchase of special fonts, photography, plugins, videos etc. This payment will be required prior to the purchase of the additional required materials.

Cyclux makes every effort to ensure websites are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular current browsers (e.g. Firefox, Microsoft Edge, Google Chrome, etc.). The client agrees that Cyclux Consult cannot guarantee correct functionality with all browser software across different operating systems.

Termination of services by the Client must be requested in a written notice or email. Telephone requests for termination of services will not be honoured until and unless confirmed in writing or email.

All Cyclux Consult services may be used for lawful purposes only. You agree to indemnify and hold Cyclux Consult harmless from any claims resulting from your use of our service that damages you or any other party.

Cyclux Consult can purchase domain names and hosting on behalf of the Client. Payment and renewal of those domain names and hosting is the responsibility of Cyclux Consult. The loss, cancellation and penalty of the domain and hosting due to late payment by the client is not the responsibility of Cyclux Consult. The Client should keep a record of the due dates for payment to ensure that payment is received in good time.

These Terms and Conditions supersede all previous representations, understandings or agreements. The Client’s acceptance via email, text or payment of an advance fee constitutes agreement to and acceptance of these Terms and Conditions. Payment online is an acceptance of our terms and conditions.
